이용약관

제1조 (목적)
이 약관은 크루즈 앱(이하 "앱")이 제공하는 서비스의 이용 조건 및 절차, 이용자와 운영팀의 권리·의무 및 책임 사항을 규정함을 목적으로 합니다.

제2조 (정의)
1. "서비스"란 앱이 제공하는 크루즈 선사·선박 정보 열람, 리뷰 작성, 커뮤니티 게시판, 여행 일정 관리 등 일체의 서비스를 말합니다.
2. "회원"이란 이 약관에 동의하고 회원가입을 완료하여 서비스를 이용하는 자를 말합니다.
3. "비회원"이란 회원가입 없이 앱이 제공하는 서비스 중 일부를 열람하는 자를 말합니다.
4. "게시물"이란 회원이 서비스 내에 작성한 리뷰, 댓글, 게시글, 이미지 등 일체의 콘텐츠를 말합니다.

제3조 (약관의 효력 및 변경)
1. 이 약관은 앱 내에 게시하거나 기타의 방법으로 이용자에게 공지함으로써 효력이 발생합니다.
2. 운영팀은 관련 법령을 위반하지 않는 범위에서 이 약관을 개정할 수 있습니다.
3. 약관을 변경하는 경우 변경 내용과 적용일을 명시하여 적용일 7일 전부터 앱 내에 공지합니다. 다만, 이용자에게 불리한 변경의 경우 적용일 30일 전부터 공지합니다.
4. 변경된 약관에 동의하지 않는 이용자는 서비스 이용을 중단하고 회원 탈퇴를 할 수 있습니다.

제4조 (서비스의 제공)
1. 앱은 다음 서비스를 제공합니다:
- 크루즈 선사 및 선박 정보 열람
- 크루즈 리뷰 작성 및 열람
- 커뮤니티 게시판 이용
- 크루즈 여행 일정 관리
2. 서비스는 연중무휴, 1일 24시간 제공을 원칙으로 합니다. 다만, 시스템 점검, 장비 교체 등 운영상 필요한 경우 서비스를 일시적으로 중단할 수 있으며, 이 경우 사전에 공지합니다.

제5조 (회원가입 및 계정)
1. 이용자는 약관 및 개인정보처리방침에 동의한 후 회원가입 절차를 완료함으로써 회원이 됩니다.
2. 회원가입은 만 14세 이상인 자에 한하여 가능합니다.
3. 회원은 가입 시 정확한 정보를 제공해야 하며, 변경 사항이 발생한 경우 즉시 수정해야 합니다.
4. 회원은 자신의 계정 정보(이메일, 비밀번호)를 관리할 책임이 있으며, 이를 제3자에게 양도하거나 대여할 수 없습니다.

제6조 (회원탈퇴 및 이용 제한)
1. 회원은 앱 내 설정 화면을 통해 언제든지 탈퇴를 요청할 수 있으며, 운영팀은 즉시 탈퇴를 처리합니다.
2. 탈퇴 시 회원의 개인정보는 개인정보처리방침에 따라 지체 없이 파기합니다. 다만, 회원이 작성한 게시물(리뷰, 댓글, 게시글)은 탈퇴 후에도 삭제되지 않으며 작성자 정보는 "탈퇴한 사용자"로 표시됩니다. 게시물 삭제를 원하는 경우 탈퇴 전에 직접 삭제하시기 바랍니다.
3. 운영팀은 회원이 다음에 해당하는 행위를 한 경우 사전 통지 후 이용을 제한하거나 회원 자격을 상실시킬 수 있습니다:
가. 타인의 정보를 도용하거나 허위 정보를 등록한 경우
나. 타인의 명예를 훼손하거나 권리를 침해하는 게시물을 작성한 경우
다. 음란, 폭력적이거나 공서양속에 반하는 게시물을 작성한 경우
라. 앱의 운영을 고의로 방해하는 경우
마. 기타 관련 법령이나 이 약관을 위반하는 경우

제7조 (회원의 의무)
1. 회원은 관련 법령과 이 약관의 규정을 준수하여야 합니다.
2. 회원은 타인의 권리를 침해하거나 불법적인 행위를 하여서는 안 됩니다.
3. 회원은 허위 정보를 등록하거나 타인의 정보를 도용하여서는 안 됩니다.
4. 회원은 앱의 정상적인 운영을 방해하는 행위를 하여서는 안 됩니다.
5. 회원은 서비스를 이용하여 상업적 광고, 홍보, 스팸 등을 게시하여서는 안 됩니다.

제8조 (게시물에 관한 권리와 책임)
1. 회원이 작성한 게시물의 저작권은 해당 회원에게 귀속됩니다.
2. 회원은 게시물을 작성함으로써 운영팀에게 서비스 운영 목적 범위 내에서 해당 게시물을 사용(복제, 전시, 배포)할 수 있는 비독점적 라이선스를 부여합니다.
3. 운영팀은 회원의 게시물이 제6조 제3항에 해당하는 경우 사전 통지 없이 삭제하거나 비공개 처리할 수 있습니다.
4. 회원은 자신의 게시물에 대해 법적 책임을 부담하며, 게시물로 인해 발생하는 분쟁에 대해 운영팀은 책임을 지지 않습니다.

제9조 (서비스의 변경 및 중단)
1. 운영팀은 운영상·기술상 필요에 따라 서비스의 전부 또는 일부를 변경할 수 있습니다.
2. 서비스를 변경하거나 중단하는 경우 변경·중단 사유와 일정을 사전에 앱 내에 공지합니다.
3. 무료로 제공되는 서비스의 변경·중단에 대해 운영팀은 별도의 보상 책임을 지지 않습니다.

제10조 (면책사항)
1. 앱에 게시된 크루즈 선사·선박 정보, 시설, 일정, 요금 등은 참고용 정보이며, 정확성이나 최신성을 보장하지 않습니다. 실제 예약 및 이용에 관한 사항은 해당 크루즈 선사에 직접 확인하시기 바랍니다.
2. 앱은 정보 제공 목적이며, 크루즈 예약·결제·중개 등의 서비스를 제공하지 않습니다. 앱에 표시되는 가격 정보는 참고 가격이며, 실제 가격과 다를 수 있습니다.
3. 앱에 사용된 크루즈 선사 및 선박 이미지의 저작권은 각 크루즈 선사에 귀속됩니다. 앱은 정보 제공 목적으로 해당 이미지를 게시하며, 저작권 관련 문의는 copyright@cruise-app.com으로 연락해 주시기 바랍니다.
4. 운영팀은 천재지변, 전쟁, 기간통신사업자의 서비스 중단 등 불가항력적 사유로 인한 서비스 중단에 대해 책임을 지지 않습니다.
5. 운영팀은 회원의 귀책 사유로 인한 서비스 이용 장애에 대해 책임을 지지 않습니다.
6. 운영팀은 회원이 게시물 또는 서비스를 통해 기대하는 수익을 얻지 못하거나 상실한 것에 대해 책임을 지지 않습니다.
7. 서비스는 "있는 그대로(AS-IS)" 제공되며, 운영팀은 서비스의 완전성, 정확성, 신뢰성, 특정 목적에의 적합성에 대해 명시적 또는 묵시적 보증을 하지 않습니다.
8. 운영팀은 서비스 이용으로 인해 발생하는 간접적, 부수적, 특별, 결과적 손해에 대해 책임을 지지 않으며, 운영팀의 총 배상 책임은 해당 회원이 최근 12개월간 앱에 지불한 금액을 초과하지 않습니다.

제11조 (면책보증 및 손해배상)
1. 회원은 자신의 게시물이 제3자의 저작권, 상표권, 초상권 등 일체의 권리를 침해하지 않음을 보증합니다.
2. 회원의 게시물 또는 서비스 이용 행위로 인하여 운영팀이 제3자로부터 소송, 클레임, 손해배상 청구 등을 받는 경우, 해당 회원은 자신의 비용과 책임으로 운영팀을 방어하고 운영팀에 발생한 모든 손해(합리적인 변호사 비용 포함)를 배상하여야 합니다.
3. 회원이 이미지를 업로드하는 경우, 해당 이미지에 대한 모든 권리를 보유하거나 적법한 사용 권한을 가지고 있음을 보증합니다.

제12조 (저작권 침해 신고 절차 — DMCA)
1. 운영팀은 저작권자의 권리를 존중하며, 저작권 침해가 의심되는 콘텐츠에 대한 신고를 접수합니다.
2. 저작권 침해 신고는 다음 사항을 포함하여 copyright@cruise-app.com으로 제출해 주시기 바랍니다:
가. 저작권자 또는 그 대리인의 성명 및 연락처
나. 침해가 주장되는 저작물의 식별 정보
다. 침해가 주장되는 콘텐츠의 위치 또는 식별 정보
라. 해당 콘텐츠의 사용이 저작권자, 그 대리인 또는 법률에 의해 허가되지 않았다는 진술
마. 신고 내용이 정확하며, 위증 시 법적 책임을 진다는 진술
바. 저작권자 또는 그 대리인의 서명(전자서명 가능)
3. 적법한 신고 접수 시, 운영팀은 해당 콘텐츠를 합리적인 기간 내에 삭제하거나 접근을 차단하며, 게시자에게 삭제 사실을 통지합니다.
4. 게시자가 이의를 제기하는 경우, 운영팀은 저작권자에게 이를 통지하며, 법적 절차가 개시되지 않는 한 합리적인 기간 후 콘텐츠를 복원할 수 있습니다.

제13조 (분쟁 해결)
1. 이 약관과 관련한 분쟁은 대한민국 법률을 준거법으로 합니다. 다만, 이용자의 거주 국가에서 강행적으로 적용되는 소비자보호 법률이 있는 경우, 해당 법률이 적용될 수 있습니다.
2. 서비스 이용과 관련하여 운영팀과 이용자 간에 분쟁이 발생한 경우, 양 당사자는 분쟁의 해결을 위해 성실히 협의합니다.
3. 협의로 해결되지 않는 경우 민사소송법에 따른 관할 법원에 소를 제기할 수 있습니다.

부칙
이 약관은 2026년 1월 1일부터 시행합니다.

Article 1 (Purpose)
These Terms govern the conditions and procedures for use of the services provided by the Cruise App (hereinafter "App"), as well as the rights, obligations, and responsibilities of the users and the operating team.

Article 2 (Definitions)
1. "Service" refers to all services provided by the App, including browsing cruise line and ship information, writing reviews, using community bulletin boards, and managing travel itineraries.
2. "Member" refers to an individual who has agreed to these Terms, completed the registration process, and uses the Service.
3. "Non-member" refers to an individual who browses certain parts of the Service without registering as a Member.
4. "Content" refers to all content created by a Member within the Service, including reviews, comments, posts, and images.

Article 3 (Effectiveness and Amendment of Terms)
1. These Terms take effect upon being posted within the App or otherwise made available to users.
2. The operating team may amend these Terms to the extent permitted by applicable laws and regulations.
3. In the event of an amendment, the details and effective date of the changes shall be announced within the App at least 7 days prior to the effective date. However, if the changes are disadvantageous to users, they shall be announced at least 30 days prior to the effective date.
4. Users who do not agree to the amended Terms may discontinue use of the Service and withdraw their membership.

Article 4 (Provision of Service)
1. The App provides the following services:
- Browsing cruise line and ship information
- Writing and browsing cruise reviews
- Using community bulletin boards
- Managing cruise travel itineraries
2. In principle, the Service is available 24 hours a day, 365 days a year. However, the Service may be temporarily suspended for operational purposes such as system maintenance or equipment replacement, in which case prior notice shall be given.

Article 5 (Membership Registration and Accounts)
1. An individual becomes a Member by agreeing to these Terms and the Privacy Policy and completing the registration process.
2. Registration is limited to individuals aged 14 or older.
3. Members must provide accurate information at the time of registration and promptly update any changes.
4. Members are responsible for managing their account credentials (email and password) and may not transfer or lend them to third parties.

Article 6 (Membership Withdrawal and Restrictions)
1. Members may request withdrawal at any time through the settings screen within the App, and the operating team shall process the withdrawal promptly.
2. Upon withdrawal, the Member's personal information shall be destroyed without delay in accordance with the Privacy Policy. However, content posted by the Member (reviews, comments, posts) shall not be deleted after withdrawal, and the author information shall be displayed as "Deleted User." Members wishing to delete their content should do so prior to withdrawal.
3. The operating team may, upon prior notice, restrict the use of or revoke membership of a Member who engages in any of the following:
a. Misappropriating another person's information or registering false information
b. Posting content that defames or infringes upon the rights of others
c. Posting obscene, violent, or content contrary to public morals
d. Intentionally disrupting the operation of the App
e. Otherwise violating applicable laws or these Terms

Article 7 (Obligations of Members)
1. Members shall comply with applicable laws and the provisions of these Terms.
2. Members shall not infringe upon the rights of others or engage in unlawful activities.
3. Members shall not register false information or misappropriate the information of others.
4. Members shall not engage in activities that interfere with the normal operation of the App.
5. Members shall not post commercial advertisements, promotions, or spam through the Service.

Article 8 (Rights and Responsibilities Regarding Content)
1. Copyright in content created by a Member belongs to that Member.
2. By posting content, a Member grants the operating team a non-exclusive license to use (reproduce, display, distribute) such content within the scope of operating the Service.
3. The operating team may delete or make private any content that falls under Article 6, Paragraph 3 without prior notice.
4. Members bear legal responsibility for their content, and the operating team shall not be liable for any disputes arising from such content.

Article 9 (Modification and Discontinuation of Service)
1. The operating team may modify all or part of the Service as operationally or technically necessary.
2. In the event of modification or discontinuation of the Service, the reasons and schedule shall be announced within the App in advance.
3. The operating team shall not be liable for compensation regarding the modification or discontinuation of services provided free of charge.

Article 10 (Disclaimers)
1. Cruise line and ship information, facilities, schedules, fares, and other information posted on the App are for reference purposes only, and their accuracy or timeliness is not guaranteed. For matters relating to actual bookings and use, please confirm directly with the respective cruise line.
2. The App is for informational purposes and does not provide cruise booking, payment, or brokerage services. Price information displayed on the App is for reference only and may differ from actual prices.
3. Copyright in cruise line and ship images used on the App belongs to the respective cruise lines. The App posts such images for informational purposes. For copyright-related inquiries, please contact copyright@cruise-app.com.
4. The operating team shall not be liable for service interruptions caused by force majeure events, including natural disasters, war, or service disruptions by telecommunications carriers.
5. The operating team shall not be liable for service disruptions attributable to the Member.
6. The operating team shall not be liable for any profits a Member expects but fails to obtain or loses through content or the Service.
7. The Service is provided "AS-IS," and the operating team makes no express or implied warranties regarding the completeness, accuracy, reliability, or fitness for a particular purpose of the Service.
8. The operating team shall not be liable for any indirect, incidental, special, or consequential damages arising from use of the Service, and the total liability of the operating team shall not exceed the amount paid by the relevant Member to the App in the preceding 12 months.

Article 11 (Indemnification)
1. Members warrant that their content does not infringe upon any third-party rights, including copyrights, trademarks, and rights of publicity.
2. If the operating team receives any lawsuit, claim, or demand for damages from a third party due to a Member's content or use of the Service, the Member shall defend the operating team at their own expense and responsibility and shall indemnify the operating team for all damages incurred (including reasonable attorney fees).
3. When a Member uploads images, the Member warrants that they hold all rights to such images or have obtained lawful authorization to use them.

Article 12 (Copyright Infringement Reporting Procedure — DMCA)
1. The operating team respects the rights of copyright holders and accepts reports of content suspected of copyright infringement.
2. Copyright infringement reports should be submitted to copyright@cruise-app.com and include the following:
a. The name and contact information of the copyright holder or their authorized agent
b. Identification of the copyrighted work alleged to be infringed
c. The location or identification of the content alleged to be infringing
d. A statement that the use of the content is not authorized by the copyright holder, their agent, or the law
e. A statement that the information in the report is accurate and that the reporting party accepts legal liability for perjury
f. The signature of the copyright holder or their authorized agent (electronic signatures accepted)
3. Upon receipt of a valid report, the operating team shall remove or disable access to the content within a reasonable period and notify the poster of the removal.
4. If the poster files a counter-notification, the operating team shall notify the copyright holder accordingly and may restore the content after a reasonable period unless legal proceedings are initiated.

Article 13 (Dispute Resolution)
1. Disputes arising in connection with these Terms shall be governed by the laws of the Republic of Korea. However, if mandatory consumer protection laws of the user's country of residence apply, such laws may take precedence.
2. In the event of a dispute between the operating team and a user relating to use of the Service, both parties shall negotiate in good faith to resolve the dispute.
3. If a dispute cannot be resolved through negotiation, either party may file a lawsuit with the competent court under the Civil Procedure Act.

Supplementary Provisions
These Terms shall take effect on January 1, 2026.

第1条（目的）
本規約は、クルーズアプリ（以下「アプリ」）が提供するサービスの利用条件および手続き、利用者と運営チームの権利・義務および責任事項を定めることを目的とします。

第2条（定義）
1. 「サービス」とは、アプリが提供するクルーズ船社・船舶情報の閲覧、レビューの作成、コミュニティ掲示板、旅行日程管理等のすべてのサービスを指します。
2. 「会員」とは、本規約に同意し、会員登録を完了してサービスを利用する者を指します。
3. 「非会員」とは、会員登録なしにアプリが提供するサービスの一部を閲覧する者を指します。
4. 「投稿」とは、会員がサービス内に作成したレビュー、コメント、記事、画像等のすべてのコンテンツを指します。

第3条（規約の効力および変更）
1. 本規約は、アプリ内に掲示またはその他の方法で利用者に通知することにより効力が発生します。
2. 運営チームは、関連法令に違反しない範囲で本規約を改定することができます。
3. 規約を変更する場合、変更内容および適用日を明示し、適用日の7日前からアプリ内に公告します。ただし、利用者に不利な変更の場合は、適用日の30日前から公告します。
4. 変更された規約に同意しない利用者は、サービスの利用を中止し、会員退会することができます。

第4条（サービスの提供）
1. アプリは以下のサービスを提供します：
   ・クルーズ船社および船舶情報の閲覧
   ・クルーズレビューの作成および閲覧
   ・コミュニティ掲示板の利用
   ・クルーズ旅行日程の管理
2. サービスは年中無休、1日24時間の提供を原則とします。ただし、システム点検、設備交換等の運営上必要な場合はサービスを一時的に中断することがあり、この場合は事前に公告します。

第5条（会員登録およびアカウント）
1. 利用者は、規約および個人情報処理方針に同意した後、会員登録手続きを完了することにより会員となります。
2. 会員登録は満14歳以上の者に限り可能です。
3. 会員は、登録時に正確な情報を提供しなければならず、変更事項が発生した場合は速やかに修正しなければなりません。
4. 会員は、自身のアカウント情報（メールアドレス、パスワード）を管理する責任を負い、これを第三者に譲渡または貸与することはできません。

第6条（会員退会および利用制限）
1. 会員は、アプリ内の設定画面を通じていつでも退会を申請することができ、運営チームは速やかに退会を処理します。
2. 退会時、会員の個人情報は個人情報処理方針に従い遅滞なく破棄します。ただし、会員が作成した投稿（レビュー、コメント、記事）は退会後も削除されず、作成者情報は「退会したユーザー」として表示されます。投稿の削除を希望する場合は、退会前にご自身で削除してください。
3. 運営チームは、会員が以下に該当する行為を行った場合、事前通知の上、利用を制限し、または会員資格を剥奪することができます：
   イ. 他人の情報を盗用し、または虚偽の情報を登録した場合
   ロ. 他人の名誉を毀損し、または権利を侵害する投稿を作成した場合
   ハ. わいせつ、暴力的、または公序良俗に反する投稿を作成した場合
   ニ. アプリの運営を故意に妨害した場合
   ホ. その他関連法令または本規約に違反した場合

附則
本規約は2026年1月1日より施行します。

服务条款

第1条（目的）
本条款旨在规定使用邮轮应用（以下简称"应用"）所提供服务的条件和程序，以及用户与运营团队之间的权利、义务和责任。

第2条（定义）
1. "服务"是指应用提供的所有服务，包括浏览邮轮公司及船舶信息、撰写评价、使用社区公告板、管理旅行行程等。
2. "会员"是指同意本条款并完成注册程序后使用服务的个人。
3. "非会员"是指未注册会员而浏览应用提供的部分服务的个人。
4. "内容"是指会员在服务中创建的所有内容，包括评价、评论、帖子和图片等。

第3条（条款的效力及变更）
1. 本条款自在应用内公示或以其他方式通知用户之日起生效。
2. 运营团队可在不违反相关法律法规的范围内修改本条款。
3. 变更条款时，应明确变更内容和适用日期，并在适用日期前7天起在应用内公告。但如果变更对用户不利，则应在适用日期前30天起公告。
4. 不同意变更后条款的用户可以停止使用服务并注销会员资格。

第4条（服务的提供）
1. 应用提供以下服务：
   - 浏览邮轮公司及船舶信息
   - 撰写和浏览邮轮评价
   - 使用社区公告板
   - 管理邮轮旅行行程
2. 原则上，服务全年无休、每天24小时提供。但因系统维护、设备更换等运营需要，可能会暂时中断服务，届时将提前公告。

第5条（会员注册与账户）
1. 用户在同意本条款和隐私政策后，完成注册程序即成为会员。
2. 仅限年满14周岁以上的个人可以注册会员。
3. 会员在注册时须提供准确信息，如有变更应立即修改。
4. 会员有责任管理自己的账户信息（电子邮箱、密码），不得将其转让或出借给第三方。

第6条（会员注销及使用限制）
1. 会员可随时通过应用内的设置界面申请注销，运营团队将立即处理注销事宜。
2. 注销时，会员的个人信息将按照隐私政策及时销毁。但会员发布的内容（评价、评论、帖子）在注销后不会被删除，作者信息将显示为"已注销用户"。如希望删除内容，请在注销前自行删除。
3. 如会员存在以下行为，运营团队可在事先通知后限制其使用或取消其会员资格：
   （一）盗用他人信息或登记虚假信息
   （二）发布损害他人名誉或侵犯他人权利的内容
   （三）发布淫秽、暴力或违反公序良俗的内容
   （四）故意妨碍应用运营
   （五）其他违反相关法律法规或本条款的行为

附则
本条款自2026年1月1日起施行。
